THE CONTENT STANDARDS TERMS form part of these Terms, By agreeing to the Terms you also agree to the Content Standards Terms.
NewsMaker enables the submission of press releases for publishing to the NewsMaker website and for distribution to selected Australian media. The nature of the service is public, and your press releases may be published on any website, including social media websites (eg, Twitter, LinkedIn, Facebook, etc) and any platform whether online or offline, anywhere in the world.
As a Registered User (Publisher), you are responsible for all the content submitted through your NewsMaker account (Submitted Content). NewsMaker receives a high volume of material and cannot be responsible for verifying or checking Submitted Content and its sources. As a Registered User, you must provide valid Contact details.
By registering, you agree not to use the NewsMaker service or website for any other purposes, including, without limitation, to store, aggregate, reproduce, screenscrape or distribute information available on the website in any manner or to compete directly or indirectly with NewsMaker or its owner NewsGallery Pty Ltd; to interfere with or disrupt the operation of the website or the networks or servers connected to the website in any manner; to impersonate any person or entity or otherwise misrepresent your affiliation with any person or entity; to upload, post or otherwise transmit any content that infringes the proprietary rights of any third party, or is otherwise unlawful or offensive; to harass or otherwise harm NewsMaker, NewsGallery or any other person or entity; or to engage in commercial activities of any kind related to the Newsmaker service without prior consent of NewsGallery Pty Ltd.
Any breach of any term or condition herein, including but not limited to infringement of a third party's copyright, may result in termination of all rights to use the service.
Any unauthorised use of the NewsMaker website may result in penalties to the full extent provided by law.
NewsMaker reserves the right to reject or delete any Submitted Content for any reason whatsoever, without explanation. NewsMaker reserves the right to make any changes to Submitted Content. NewsMaker reserves the right to edit Media Lists to help ensure their relevance to a topic.
Newsmaker makes every effort to review Submitted Content and to process it within 24 hours of receipt. Should a faster turnaround be required, you must inform us 24 hours in advance. Should Newsmaker cause an error in timing, we will provide a refund however the refund represents the full extent of our liability. NewsMaker accepts no liability for the activities of third parties, including malicious and non-malicious activities or conditions including but not limited to weather conditions or technical issues.
NO WARRANTY OR GUARANTEE
No warranties, assurances or agreements are provided, except those limited to publishing the press release to the NewsMaker website for a limited period, and emailing it to selected Australian media.
NewsMaker and its owner NewsGallery do not warrant that its services will meet any other expectations or requirements; or that they will be free from delay or error, excepting in jurisdictions that legislate against exclusion of warranties.
- NewsMaker does not warranty or guarantee that your press release will be published.
- NewsMaker does not warranty or guarantee that your press release will be delivered to every journalist on a media list.
- NewsMaker does not warranty or guarantee that your press release will be successful in obtaining media coverage.
After publication by a Registered User:
- NewsMaker reserves the right to email Submitted Content to any party.
- NewsMaker reserves the right to archive published press releases after a period of 30 days.
Limitation of Liability
By using the NewsMaker service, you agree that NewsMaker and its associated businesses, such as NewsGallery, will not be held liable for any improper or incorrect use of the website or materials, including all Submitted Content. NewsMaker and its associated businesses assume no responsibility for any user's activities on the website or for the inaccuracy of any content on the website or in a press release or in any subsequent media coverage or publishing elsewhere.
In no event will NewsMaker or its associated businesses be liable for any direct, indirect, incidental, special, exemplary or consequential damages, including, without limitation, procurement of substitute goods or services, loss of use, data or profits, or business interruption, arising in any way out of the use of, or inability to use, the website or the materials on the website or the inaccuracy of any content on the website, however caused, under any theory of liability. This disclaimer of liability applies to any damages or injury under any cause of action, including, without limitation, those caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus or bug, communication line failure, theft, destruction or alteration of or unauthorised access to the website or content on the website. The content of all press releases published on or distributed from this website is the sole responsibility of the originating party. You agree that NewsMaker and its associated businesses are not responsible and will not be held liable for any third party content on the website or any third-party content, products or services available on other websites accessed through links from the NewsMaker website. Links to third-party sites are for your convenience only, and their inclusion on the NewsMaker website does not imply any endorsement, guarantee, warranty or representation by NewsMaker or its associated businesses.
- NewsMaker reserves the right to remove accounts that have never been used, after a period of 60 days.
- NewsMaker reserves the right to remove accounts that have invalid contact details.
PENALTIES FOR UNPAID SUBSCRIPTIONS
Invoices are sent for the following month's use. Payments must be made in advance. If an invoice remains unpaid for more than 1 month, Newsmaker reserves the right not only to suspend the account but to archive ALL Submitted Content in a Subscriber Account from the website.
SPECIFIC RESTRICTED PRESS RELEASE CONTENT
NewsMaker reserves the right to refuse to publish Submitted Content for any reason, but in particular in the following groups and categories:
- Excessively repeat content or spam
- Adult (eg, pornography)
- Financial services such as get rich quick schemes
- Any press release with unsubstantiated claims, including claims that are disputed by a third party
NB: If Submitted Content is disputed by a third party, NewsMaker reserves the right to remove it pending resolution.
NewsMaker also reserves the right to reject any press release application that the service moderator believes is not suited to the selected media categories.
The NewsMaker website and all materials on the website, including, without limitation, "NewsMaker" and all other trademarks and logos on the website, are protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as specifically permitted in this Agreement, the NewsMaker Membership agreement or by express written consent of NewsGallery, you may not use the website or the material on the website in any manner.
Rights Reserved / Change in Terms
Any rights not expressly granted herein are reserved. NewsGallery and its associated businesses reserve the right to make changes to these Terms and conditions of use at any time and for any reason. All such changes will become effective immediately after posting of such notice. Your continued use of the website after the date such changes become effective will constitute your acceptance of the changes and your agreement to be legally bound by any modifications or amendments to these Terms and conditions.
