The Asociación para la Prevención y Estudios de Delitos, Abusos y Negligencias en Informática y Comunicaciones Avanzadas (APEDANICA) was granted leave to intervene as a third party – amicus curiae – in the Case of STICHTING LANDGOED STEENBERGEN AND OTHERS V. NETHERLANDS, pending before the European Court of Human Rights, an important case on matters of e-government.
The Case conerns the failure to exercise fundamental rights, complained of by some Netherlandese applicants, due to the excessive “modernity” of Netherlands’ public administration, which, in the case of matter, served a decision concerning urbanistic undertakings only through public notice via its official website.
The Case, extremely delicate for its implications, will shed light over the adequacy and safeguards, modern e-government and e-governance systems, of the likes of the Netherlandese indeed, possibly provide to citizens and the risks they entail, while taking in due account the public administration need for efficiency and modernity.
APEDANICA’s team, that stepped in to the Netherlandes citizens’ defence, is composed, beside Achille Campagna, a Sanmarinese lawyer and notary, by Prof. Antonio Martino, of Pisa’s University, living in Argentina, by Mexican notary Emilio del Rio Pacheco, and by the same President of APEDANICA, engineer Miguel Gallardo.
The European Court of Human Rights, in all its history, has granted leave to intervene on an amicus curiae basis in little more than 500 cases.>
