By registering to use the NewsMaker service, you agree to become a NewsMaker member, bound by the following terms of use, limitations, quality policy and fair use policy.

NewsMaker enables the submission of news releases for publishing to the NewsMaker website and to your own website, and for distribution to selected Australian media. Your releases may also be published on affiliated websites and on social websites (eg DIGG, Facebook, MySpace, etc.).

By registering, you agree not to use the NewsMaker service or website for any other purposes, including, without limitation, to store, aggregate, reproduce or distribute information available on the website in any manner or to compete directly or indirectly with NewsMaker or its owner NewsGallery Pty Ltd; to interfere with or disrupt the operation of the website or the networks or servers connected to the website in any manner; to impersonate any person or entity or otherwise misrepresent your affiliation with any person or entity; to upload, post or otherwise transmit any content that infringes the proprietary rights of any third party, or is otherwise unlawful or offensive; to harass or otherwise harm NewsMaker, NewsGallery or any other person or entity; or to engage in commercial activities of any kind without prior consent of NewsGallery Pty Ltd.

Any unauthorised use of the NewsMaker website may result in termination of all rights to use the service and penalties to the full extent provided by law.

NewsMaker reserves the right to reject any press release submission for any reason whatsoever, without explanation. NewsMaker also reserves the right to make any changes in a press release submitted: these changes would typically be for editing purposes to ensure releases are of a professional quality and gain maximum exposure. NewsMaker reserves the right to make changes to spelling, wording, syntax, headlines, key points and body copy. 

Once published, the Member agrees that his or her press release is public property. NewsMaker therefore reserves the right to email your press release to any party, once published, and to publish your press release on other websites.

By completing and submitting the Membership Application, you agree to be bound by the terms of use above and the Fair Use and Quality Policies.

Fair Use

NewsMaker will at no time send a single press release to more than 20 media categories simultaneously. This proviso is designed to ensure the service results in targeted and effective distribution of press releases to Australian media; that the service is not used to indiscriminately bombard recipients with press releases; and to ensure that the system does not breach the Spam Act 2003.

NewsMaker also reserves the right to reject any press release application that the service moderator believes is not suited to the selected media categories.

Disclaimer of Warranties

By registering to become a member of NewsMaker or by logging in to the website and/or using the service, you agree that use of the website is entirely at your own risk, including any subsequent media interviews or media coverage or other result obtained.

No warranties, assurances or agreements are provided, except those limited to publishing the press release, once approved, to the NewsMaker website, and emailing it to selected Australian media.

NewsMaker and its owner NewsGallery do not warrant that its services will meet any other expectations or requirements; or that they will be free from delay or error, excepting in jurisdictions that legislate against exclusion of warranties.

Limitation of Liability

By using the NewsMaker service, you agree that NewsMaker and its associated businesses, such as NewsGallery, will not be held liable for any improper or incorrect use of the website or materials, including all press releases and commentator profiles. NewsMaker and its associated businesses assume no responsibility for any user's activities on the website or for the inaccuracy of any content on the website or in a press release or in any subsequent media coverage or publishing elsewhere, including other websites.

In no event will NewsMaker or its associated businesses be liable for any direct, indirect, incidental, special, exemplary or consequential damages, including, without limitation, procurement of substitute goods or services, loss of use, data or profits, or business interruption, arising in any way out of the use of, or inability to use, the website or the materials on the website or the inaccuracy of any content on the website, however caused, under any theory of liability. This disclaimer of liability applies to any damages or injury under any cause of action, including, without limitation, those caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus or bug, communication line failure, theft, destruction or alteration of or unauthorised access to the website or content on the website. Some jurisdictions do not allow the exclusion of liability for incidental or consequential damages, so some or all of the above exclusions or limitations may not apply to you.

The content of all press releases published on or distributed from this website is the sole responsibility of the originating party. You agree that NewsMaker and its associated businesses are not responsible and will not be held liable for any third party content on the website or any third-party content, products or services available on other websites accessed through links from the NewsMaker website. Links to third-party sites are for your convenience only, and their inclusion on the NewsMaker website does not imply any endorsement, guarantee, warranty or representation by NewsMaker or its associated businesses.

Proprietary Rights

The NewsMaker website and all materials on the website, including, without limitation, "NewsMaker" and all other trademarks and logos on the website, are protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as specifically permitted in this Agreement, the NewsMaker Membership agreement or by express written consent of NewsGallery, you may not use the website or the material on the website in any manner.

Rights Reserved / Change in Terms

Any rights not expressly granted herein are reserved. NewsGallery and its associated businesses reserve the right to make changes to these terms and conditions at any time and for any reason by posting a notice on the website home page. All such changes will become effective 10 days after posting of such notice. Your continued use of the website after the date such changes become effective will constitute your acceptance of the changes and your agreement to be legally bound by any modifications or amendments to these terms and conditions.
